1. Who we are

InduIndex is operated by Solvera Systems, registered with the Dutch Chamber of Commerce (KvK 97843776) in Mijdrecht, the Netherlands — "we" in these terms. You can reach us at info@induindex.com.

2. The service

InduIndex analyzes alarm and event-log exports from industrial automation systems. You upload an export; the service parses it, runs a deterministic rules engine against ISA-18.2 / EEMUA 191 practice, and produces findings, KPIs and benchmark reports. An AI assistant can explain findings and answer questions grounded in your own data.

The service is in early access. Features may change, and pilot accounts run free and metered while pricing is finalized. We will give notice before any change that affects what a paid plan includes.

3. Your account

• Provide accurate account information and keep your credentials to yourself.
• An account is personal; each user of your team needs their own.
• You are responsible for what happens under your account. Tell us promptly at the address above if you suspect unauthorized use.

4. Your data stays yours

• You keep all rights to the files you upload and the reports the service generates from them.
• You grant us a license to store and process your uploads only as needed to provide the service to you. It ends when the data is deleted.
• We do not train machine-learning models on your data, do not sell it, and do not build shared knowledge bases from it. Each customer's data is isolated from every other customer's, enforced in the database layer.
• You can request deletion of your files or your whole account at any time; deletion covers stored files and everything derived from them. Details, including timelines, are in the Privacy Policy.

5. Processing data on your behalf

Uploaded exports sometimes contain personal data — operator names or user IDs in event-log columns. For that data you are the controller and we act as your processor under Art. 28 GDPR: we process it only to provide the service, keep it confidential, use only the sub-processors listed in the Privacy Policy, tell you without undue delay about any personal-data breach affecting it, help you respond to data-subject requests where the service cannot do so itself, and delete it when you delete the file or the account. Where possible, remove operator columns before upload — the analysis does not use them, and unmapped columns are dropped during normalization anyway.

6. Acceptable use

• Only upload content you have the right to use. Supplier manuals and vendor documentation are subject to the vendor's own terms — do not upload documents you are not licensed to process.
• Do not attempt to access other customers' data, probe or overload the service, or resell access without our written agreement.
• Do not use the service for anything unlawful.
• We may suspend accounts that break these rules; where reasonable, we will warn you first.

7. Credits, subscriptions and payment

• Paid plans are billed as subscriptions through Stripe; each period grants a credit allowance, and running an analysis spends credits.
• Subscription credits that are unspent at the end of a billing period expire. Purchased top-up credits do not expire.
• Spent credits are not refundable. If we materially reduce what a credit buys, we will give notice before it takes effect.
• Prices are shown before purchase; changes apply from your next billing period, announced in advance.

8. Right of withdrawal (consumers)

If you buy as a consumer in the EU, you have a 14-day right of withdrawal. By starting to use a paid plan immediately, you consent to immediate performance and acknowledge that the right of withdrawal lapses for service already delivered; you keep it for the undelivered remainder. Business purchases are outside the withdrawal regime.

9. What the analysis is — and is not

Every number, tag and standard citation in a report comes from the deterministic rules engine; the AI writes explanatory prose around them. The output is decision support for qualified engineers: verify findings against your own installation before acting on them.

The service is not a safety instrument. It does not certify compliance with any standard, does not perform or replace a risk assessment, and its output must not be used as the basis for safety sign-off. A report can only describe what is present in the export you provided.

10. Third-party names

Vendor and product names — Siemens, Beckhoff, Rockwell/Allen-Bradley, WinCC, FactoryTalk, Ignition and others — are used only to describe which systems' exports the service can read. InduIndex is independent and is not affiliated with, endorsed by, or sponsored by any of these vendors.

11. Availability and changes

We aim for reliable operation but offer no uptime guarantee during early access. We may change or discontinue features; if a change removes something material from a paid plan, we will tell you in advance and you may cancel before it takes effect.

12. Liability

To the extent Dutch law allows, our total liability for claims arising from the service is capped at the fees you paid us in the twelve months before the claim arose, and we are not liable for indirect damage such as lost production, lost profit or lost data — with the standing exceptions Dutch law does not let anyone contract away (intent and deliberate recklessness). Nothing here limits your statutory rights as a consumer.

13. Ending the agreement

• You can stop using the service and request account deletion at any time; see the Privacy Policy for what deletion covers.
• We can end the agreement with notice if you materially breach these terms and do not remedy the breach after being asked.
• On termination, sections that by their nature survive (data protection, liability, governing law) keep applying.

14. Changes to these terms

We may update these terms. For material changes we will notify you by email or in the product at least 14 days in advance; continuing to use the service after that date counts as acceptance.

15. Governing law

Dutch law applies. Disputes go to the competent court of the Midden-Nederland district (Rechtbank Midden-Nederland), the Netherlands, unless mandatory consumer law gives you another venue.
